The reference to any mechanical or electrical equipment or other facilities at the property shall not constitute a representation (unless otherwise stated) as to its state or condition or that it is capable of fulfilling its intended function. Prospective tenants/purchasers should satisfy themselves as to the fitness of such equipment for their requirements.

We make every effort to check and test material at all stages of production. It is always wise for you to run an anti-virus program on all material downloaded from the Internet. We cannot accept any responsibility for any loss, disruption or damage to your data or your computer system which may occur whilst using material derived from this website.

Termination

Your authorisation to use the Eckersley website automatically terminates without notice if you fail to comply with any of the Terms and Conditions with decisions being made at our sole discretion. Upon termination, you must cease all use of the Eckersley website and destroy all and any materials copied directly or indirectly from the Eckersley website.

Non Waiver

Eckersley’s failure to insist upon strict enforcement of any provision of this agreement shall not be construed as a waiver of any provision or right.

General

These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales. Any dispute arising under these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Data Protection and Privacy

Eckersley will take all reasonable commercial steps to protect your privacy in its capacity as Data Controller and Data Processor.

Eckersley collects data from you only insofar as it is needed for the performance of work instructed, or in compliance with identity checks as required by anti money laundering legislation.

Eckersley’s legal basis for the collection and processing of your data is therefore in the performance of the contract between Eckersley and yourself.

Eckersley will contact you from time to time in relation to the various services we offer, where we consider you may have a legitimate interest in those services, but we will never give your personal data to any third party other than in the performance of our contract.

You are entitled to opt out of receipt of this internal marketing should you so wish.

While Eckersley may provide aggregate statistics to others, these will contain no information to identify you personally. Any information that you have provided to the company that might identify you personally will not be used in any way that you have not given permission for.

You should be aware that Eckersley collects and analyses information that is given to it from a variety of sources. Data collected from you will be retained only for as long as is required by RICS, the professional body of which Eckersley is a member.
